1. Overview
This Privacy Policy outlines the terms and conditions governing the use of photographs and deliverables provided by Ven Camilo Photography, a DBA of Instructionally Ven LLC. By engaging with Ven Camilo Photography, you agree to the terms below, which are designed to protect both the client and the business and ensure a hospitable, professional experience. This policy complies with applicable state of California and federal regulations.
2. Non-Commercial Use Agreement
All deliverables are intended for personal, non-commercial use unless otherwise explicitly communicated, outlined, and agreed upon in writing. Clients agree that deliverables (including photos, digital files, or videos):
Will not be used for commercial purposes (advertising, promotions, resale, etc.) without prior written consent.
Require a separate licensing agreement for any extended or commercial use.
By default, all sessions are assumed to fall under personal-use licensing, and clients should expect their deliverables to reflect this unless commercial terms have been established in advance.
3. Social Media and Online Usage
Clients may share deliverables online under the following conditions:
Proper credit is attributed to Ven Camilo Photography (e.g., tagging @ven.camilo).
No filters or alterations are applied that significantly change or misrepresent the work.
Third-party use (e.g., vendors, partners) requires prior written approval and may incur licensing fees.
4. Copyright and Intellectual Property By booking with Ven Camilo Photography, clients also grant permission for the use of their images for personal marketing, portfolio display, and social media content unless a written waiver is submitted prior to the shoot. This may include, but is not limited to, display on the business website, promotional materials, Instagram, or other social media platforms.
Clients who do not wish for their images to be used for any form of marketing or promotional purposes must notify Ven Camilo Photography in writing before the session takes place. Opting out does not impact the quality or scope of services provided.
All deliverables remain the sole intellectual property of Instructionally Ven LLC unless otherwise agreed in writing. Clients are granted a limited-use license for personal use only. Commercial use, resale, or distribution outside of agreed-upon terms is strictly prohibited without written authorization and appropriate licensing fees.
By default, deliverables are for non-commercial, personal use as outlined in Section 2. Any additional rights must be explicitly negotiated and confirmed in writing before use.
Ven Camilo Photography retains the right to use deliverables for portfolio, marketing, and promotional purposes unless a written request to opt out is received prior to the shoot.
Clients are responsible for informing the photographer of any third-party usage intentions (e.g., vendor marketing, brand collaborations). Unauthorized commercial usage will result in retroactive licensing fees and may incur additional legal remedies.
5. Commercial Licensing
Commercial use must be negotiated in advance. Licensing fees vary depending on use, scale, and exclusivity:
Small Business: $500–$1,000 per image
Medium/Large Business: $1,000–$5,000 per image
Exclusive Rights: Add 50–100% to base
Example: A small business social media use = $500 for 1-year license. Exclusive, national campaign = $5,000–$8,000 with full rights.
6. Privacy of Personal Information
Client information (name, contact info, etc.) is used solely for booking, communication, and service delivery. Instructionally Ven LLC does not sell or share personal information, except as required by law.
7. Assumption of Risk
By booking services, clients acknowledge and accept the following:
Uncontrollable Factors: Weather, lighting, and venue limitations may affect final images. Best efforts will be made to adapt.
Client-Chosen Locations: Clients accept responsibility for location-based issues (e.g., crowds, restrictions) unless location was selected by the photographer.
Client-Caused Delays: Tardiness, lack of preparedness, or disruptions caused by the client or their guests may result in shortened shooting time, rushed sessions, or missed shots. Ven Camilo Photography is not liable for reduced quality or missed deliverables in such cases. Refunds or reshoots will not be provided due to client-caused delays.
Hair & Appearance Clause: Clients are expected to arrive photo-ready, including hair styled and managed. Please bring items such as hair spray, gel, brushes, or any grooming tools needed to maintain your appearance throughout the shoot. Hair is particularly difficult to edit in post-production. While minor retouching (flyaways, lighting, blemishes) is included, extensive appearance corrections fall under excessive editing and may incur a $150 fee.
Editing: Modest editing (light, blemishes, flyaways) is included.
Excessive editing (removing crowds, distractions) is $150 and only applies when outside normal adjustments. This will be discussed prior to final delivery.
8. Force Majeure
Instructionally Ven LLC is not responsible for service delays or inability to perform due to events beyond control (e.g., natural disasters, restrictions, technical issues).
9. Liability and Indemnification
Liability is limited to the total fee paid. Clients waive claims due to factors beyond reasonable control and agree to indemnify the business against misuse or unauthorized use of deliverables.
10. Amendments
Instructionally Ven LLC reserves the right to update this policy at any time. Clients will be notified of significant changes via email or preferred communication method.
11. Governing Law
This policy is governed by the laws of California.
