This policy outlines how Ven Camilo Photography, a DBA of Instructionally Ven, LLC, handles client information and the use of photographs and deliverables. By booking with Ven Camilo Photography, you agree to the terms below. They're here to protect both you and the business and to keep the experience professional and welcoming. This policy follows applicable California and federal regulations.

2. Your Personal Information

The information you share, like your name, contact details, and session details, is used only for booking, communication, and delivering your photos. Ven Camilo Photography does not sell or share your personal information with anyone, except where required by law.

3. How You Can Use Your Photos

Your deliverables are for personal use. You're welcome to print them, share them, and keep them however you like for your own personal enjoyment and records.

Commercial use, meaning using the images for advertising, promotions, resale, or any business purpose, requires a separate written agreement in advance. If that's something you're interested in, just reach out and we'll talk it through.

4. Sharing on Social Media

You're always welcome to share your photos on social media. If you'd like to tag or credit Ven Camilo Photography, that's genuinely appreciated, but it's never required.

The only ask is that you avoid heavy filters or edits that significantly change the look of the work, since a lot of care goes into your final gallery.

5. Copyright and Ownership

All photographs remain the intellectual property of Instructionally Ven, LLC d/b/a Ven Camilo Photography. You receive a personal, non-exclusive license to use your images for personal purposes. Just so you're aware, photos taken on modern cameras generally carry copyright and ownership details imprinted in the original file data as a standard part of how the images are created.

By booking, you also give permission for your images to be used for portfolio display, marketing, and social media content. If you'd prefer your images not be used for any promotional purposes, just let me know in writing before your session. Opting out has no effect on the quality or scope of your service in any way.

6. Commercial Licensing

Commercial licensing is available and handled on a case-by-case basis, quoted based on how the images will be used. Ven Camilo Photography is based in San Diego and works with local businesses on commercial needs. If you have a commercial use in mind, reach out and we'll put together terms that fit.

7. Turnaround and Delivery

Your edited gallery is typically delivered within about 5 business days, or roughly one full calendar week, following your session. This is a good-faith estimate to set fair expectations, not a binding deadline, and it can vary based on volume, season, and editing scope. Every effort is made to deliver in a timely manner, and reasonable variation from the estimate is not considered a breach.

Photos are delivered through a secure gallery link with a 30 day download window. After 30 days the link expires, but everything is archived, so if you ever need your photos again down the road, just ask.

8. What's Included and Editing

Sessions are all inclusive. Every image that passes the quality assurance process is delivered fully edited, with duplicates minimized. Editing includes true-to-tone lighting adjustments and modest retouching such as blemishes, flyaways, and minor distractions on skin or clothing.

Extensive retouching, like removing crowds or major background objects, goes beyond standard editing and may involve an additional fee, which would always be discussed with you in advance.

A quick note on hair. Hair is one of the hardest things to correct naturally in post-production. Every reasonable effort is made to address flyaways and stray strands during editing, but for best results, arriving with hair styled and managed goes a long way. This note is simply here for transparency.

9. Session Conditions and Assumption of Risk

By booking, you acknowledge and accept the following:

Uncontrollable factors. Weather, natural lighting, and venue limitations can affect final images. San Diego lighting in particular isn't always in our favor, and conditions like marine layer, coastal fog, and shifting sun throughout the day are outside the photographer's control. Every effort is made to work with the light available and adapt on the day.

Client-chosen locations. When you select the location, you accept responsibility for location-based issues like crowds or restrictions, unless the photographer chose the spot.

Client-caused delays. Tardiness or lack of preparedness from the client or their guests may result in shortened shooting time. The photographer isn't liable for reduced coverage in those cases.

10. Client Satisfaction

The photographer delivers a professionally edited gallery from each session. Refunds are not offered on completed sessions. If you have concerns about your delivered images, reach out and they'll be reviewed, with additional edits provided within reason. A reshoot is not standard and may only be offered at the photographer's sole discretion. Once the final gallery is delivered, the session is considered complete.

11. Force Majeure

Instructionally Ven, LLC is not responsible for service delays or inability to perform due to events beyond reasonable control, including natural disasters, government restrictions, or technical issues. In such cases, both parties will work in good faith to reschedule.

12. Liability and Indemnification

The photographer is not liable for circumstances beyond reasonable control, including weather, venue restrictions, natural lighting changes, third-party interference, or Acts of God, except for claims arising from the photographer's own negligence or misconduct.

Each party agrees to indemnify, defend, and hold harmless the other, in good faith, from claims, damages, losses, or expenses that arise from that party's own negligence, misconduct, or breach. The client is responsible for claims arising from the conduct of the client or session guests, and the photographer is responsible for claims arising from the photographer's own actions. This is meant to allocate responsibility based on fault, and both parties commit to acting reasonably and in good faith.

13. Amendments

Instructionally Ven, LLC reserves the right to update this policy at any time. Clients will be notified of significant changes by email or their preferred method of communication.
